By accessing and using blueridge.town (the "Website" or "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of those changes.

2. Description of Service

blueridge.town is powered by the Helpible platform and provides the following services:

• Local business directory and listings for the Blue Ridge, Georgia area
• Cabin rental information and booking referrals to third-party platforms (Airbnb, VRBO, etc.)
• Event listings and local information
• AI-powered trip itinerary generation
• User account features including saving favorites and itineraries
• Weather and traffic information

We act as an information aggregator and do not directly provide lodging, food service, or other tourism services. All bookings and transactions occur through third-party providers.

3. Business Listings & Data

Where Our Data Comes From: Business listing information on blueridge.town comes from two sources: (1) direct submissions by business owners, and (2) publicly available information such as Google Places data, public calendars, and official websites. We may create a basic unclaimed listing for a local business using publicly available information to keep the directory complete. For full details, see our Data Sources page.

Who Owns Listing Content: Business owners retain ownership of the content they submit (descriptions, photos, details). We display this content on blueridge.town to help travelers find local businesses. We do not claim ownership of owner-submitted content and will not use it outside of the blueridge.town platform without permission. Paid access controls display and promotion, not ownership. Removing a subscription does not transfer ownership of your content.

Corrections and Removal (Always Free): Any business may request factual corrections (hours, address, phone, description) or full removal of their listing at any time, for any reason, with no fee or subscription required. Accuracy and removal are rights, not paid features. Contact us at info@blueridge.town or through our contact form. There is no lock-in, no contract obligation, and no consequences for requesting removal.

Unclaimed Listings (Free Baseline): Every business may appear on blueridge.town even without an account. Unclaimed listings include basic information (name, category, general location) and appear in search results, map views, and baseline AI trip planner results at non-priority levels. Information on unclaimed listings may be limited or auto-generated from public sources. Unclaimed listings have no direct control over listing fields and no access to analytics or promotional placement.

What Paying Changes: Business Standard subscribers can claim and manage their listing, edit all core details, receive priority placement in search and category results, access enhanced listing fields (amenities, tags, details), receive increased weighting in AI trip planner recommendations, and view basic performance analytics. Business Premium includes everything in Standard plus featured and spotlight placement, highest AI recommendation weighting, advanced analytics, promotional tools, and priority support. What Happens If You Stop Paying: If you cancel a paid plan, your listing remains on blueridge.town but reverts to an unclaimed listing. It is not removed or hidden. Priority placement, enhanced fields, and analytics access are removed. Owner-submitted content may be archived but not displayed. No penalties or restrictions apply. You can re-upgrade at any time.

4. User Accounts

To access certain features of our Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activities.

5. User Conduct

When using our Service, you agree NOT to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use automated means to access the Service without our permission
• Submit false or misleading information
• Harass, abuse, or harm other users

6. Intellectual Property

The Service and its original content (excluding content provided by users or third parties), features, and functionality are owned by blueridge.town and Helpible, and are protected by United States and international copyright, trademark, and other intellectual property laws.

Business listings, photos, and other content provided by third parties remain the property of their respective owners. We display such content under fair use principles or with permission.

7. Disclaimers and Limitations

Information Accuracy: While we strive to provide accurate and up-to-date information, we make no warranties or representations about the accuracy, reliability, or completeness of any information on our Service. Business hours, prices, availability, and other details may change without notice.

Third-Party Services: Our Service contains links to and information about third-party businesses and services. We are not responsible for the practices, content, or services of these third parties. Any transactions you conduct with third parties are solely between you and that party.

AI-Generated Content: Our trip planning feature uses artificial intelligence to generate itinerary suggestions. These are provided for informational purposes only and should be verified before relying on them. AI-generated content may contain errors or outdated information.

No Professional Advice: Nothing on this Service constitutes professional travel, legal, or financial advice. Always verify information independently and consult appropriate professionals when needed.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUERIDGE.TOWN AND ITS OWNERS, OPERATORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or other intangible losses
• Personal injury or property damage related to your use of the Service
• Unauthorized access to or alteration of your data
• Any issues arising from third-party services accessed through our platform
• Errors or inaccuracies in content, including AI-generated content

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless blueridge.town and its owners, operators, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit to the Service

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Fannin County, Georgia, or the Northern District of Georgia.

By using our Service, you consent to the personal jurisdiction of these courts and waive any objection to venue in these courts.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. We encourage you to review these Terms periodically.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
